The terms below define the agreement between the client and Circuit PUNKware.
The general terms must be agreed to for all clients using any service while the specific section for defined services is only relevant per service used.
Exporting a website from Circuit PUNKware is available upon request.
Domain and HTTPS Certificate RenewalCircuit PUNKware will handle all HTTPS Certificate renewal assuring websites hosted will have a valid Certificate.
It is expected that the user buy a domain name unless agreed otherwise.
The user is responsible for renewing their domain name.
The client agrees to follow all legal requirements defined by the The US Federal Government and the State of Texas. The client acknowledges that violating the scope of the terms set to use the hosting service may result in the suspension or termination of the host.
Liability for Content HostedCircuit PUNKware Provides virtualized hosts for their clients to use for hosting their own content.
The client acknowledges that by using the hosting service that they are the solely responsible for the content they put on their provided virtual host.
The client acknowledges that Circuit PUNKware can terminate the service upon any Unacceptable Use Cases defined above.
The client may not be refunded for the hosting if such a termination of service occurs.
The User Understands that Circuit PUNKware uses a custom in-house modular website development kit for rapid web development.
This means each website sits on top of a framework layer that is an extension of the in-house development kit.
In the case a user wants to export their site the website will be decoupled from the framework layer it sits on.
This means the exported website will be a fully functional static website but specific features like forms, logins and data storage including any add-ons will no longer work or be present in the exported version.
Development ProcessThe user understands the typical development time for a website to be built is 1 day to a week unless stated beforehand.
This process of development requires the user to provide information for building the website. This includes photos, logo, brand colors, summaries and social media pages.
The user understands the development time depends their ability to provide the information needed for the developer to build it.
By texting a keyword to a Circuit PUNKware provided number you agree to receive automated SMS replies related to that keyword. These messages are sent solely in response to your inbound message and are not unsolicited. Message and data rates may apply depending on your carrier and plan.
Opt-OutYou may stop receiving messages at any time by replying STOP. You will receive one confirmation message and no further messages will be sent.
DataYour phone number and message content are used only to operate the SMS service and deliver replies. This data is not sold or shared with third parties. See our Privacy Policy for full details.
Acceptable UseThis service is intended for customer inquiries and informational replies. It may not be used for unlawful purposes or to send unsolicited messages to others.
The client acknowledges that no hosting service has 100% up time and possible downtime may occur.
The SLA for the digital hosting infrastructure downtime is 97.26% per year.
This is 10 days or 240 hours of agreed upon downtime.
In the case where hosting is inaccessible due to censorship Circuit PUNKware will work quickly to get hosting back on line.
The estimated time to set up digital hosting infrastructure back online is likely less than but may be up to 2 weeks.
The Client Acknowledges Circuit PUNKware will not be responsible for loss of data or breach of agreement in this case.
