The general terms must be agreed to for all clients using any service while the specific section for defined services is only relevant per service used.

Virtualized Web Host Service

By Using this service you acknowledge that this is not physical hosting service but an IaaS (Infrastructure as A Service) based on digital infrastructure to provide hosting and maintain your website or web services.

What the host is not

While the hosting service provided allows access to your own linux based machine that hosts your web services.
The service provided is not a full VPS service and there may be limitations due to this on back end system configuration.
For technical limitations please reach out and you can be provided with further technical details.

Defined Responsibilites

The client aknowledges that no technical support outside of the back end infrastructure required to host it will be provided for their host.
The technical support for the back end infrastructure is defined as the required maintenance and support to keep a host running and accessible for the clients.

Adjustments to Resources

Some hosts may be adjusted from the standard hosting specifications (Disk Space, Memory and CPU Usage). In cases where the hosts specifications are greater than required they may be lowered to reduce infrastructure costs and therefore increase affordability. The client is entitled to the full resources purchased and in a case where resources have been lowered they will be increased upon request.

Downtime

The client acknowledges that no hosting service has 100% uptime and possible downtime may occour.
Upon downtime longer than 7 days the provided service is automaticly terminated and the client will be provided with free hosting for the number of days reamining within that month where the downtime occoured.

Security

Physical Security is managed by the Cloud Infrastructure Provider that the digital hosting infrastructure owned by Circuit PUNKware is built on top of and therefore is out of the scope of this service. Standard Security measures are taken to assure a secure environment for hosting. The client acknowledges full responsibility for their host and website security.

Loss of Data

It is the clients responsibility to assure they keep a backup of their website, databases and files.

Right to Privacy

While access to the provided hosts is possible, The hosts are only manually accessed upon request on behalf of the clients permission.
For clients that grant access, execution of commands to install required updates and configuration may be done through automated means for maintenance.
The host provided to the client is not monitored or scanned, Clients are given full privacy and control of their host.
Clients are more than free to install tools and configure their hosts to provide the level of privacy they feel they require.
Storage for all hosts is automatically encrypted at the infrastructure level.

Unacceptable Use Cases

The client agrees to follow all legal requirements defined by the The US Federal Government and the State of Texas. The client acknowledges that violating the scope of the terms set to use the hosting service may result in the suspension or termination of the host.

Liability for Content Hosted

Circuit PUNKware Provides virtualized hosts for their clients to use for hosting their own content.
The client acknowledges that by using the hosting service that they are the solely responsible for the content they put on their provided virtual host.

Termination

The client acknowledges that Circuit PUNKware can terminate the service upon any Unacceptable Use Cases defined above.
The client may not be refunded for the hosting if such a termination of service occours.

This service is under experemental development to provide continuous improvements to the service.
While it is extemly unlikely and resiliency mechanisms are in place, a very low chance of infrastructure failure exsists.
By using this service the client aknowledges this risk.

Web Development

Web Development is agreed upon by terms outside of this document. The client shall receive an agreement on paper or email that defines the scope of the agreement.

Domain Setup

Domain Setup is agreed upon by terms outside of this document. The client shall receive an agreement on paper or email that defines the scope of the agreement. Renewal of Domain and Domains Cost is outside of services pricing.
